Terms and Conditions for the rental of Pueblo Colorado


Definitions

Pueblo Colorado: "The venue" is the property subject to these terms and conditions.

Operator: Pueblo Colorado is owned and operated by TierraMitica S.A.C (the "Operator"), also referred to as "we" or "us."

Hirer: The hirer is the person or entity renting Pueblo Colorado, also referred to as "you," or "the group.”

Responsibilities

We will agree with you on the terms of the rental, the services that you require and the fees to be charged prior to you making the initial deposit. A rental agreement will be given to you witch will specify the services that you require and the total price of your stay in Pueblo Colorado.
Unless otherwise specified in the rental agreement, the following responsibilities will apply.

Our responsibilities
Subject to the terms of our rental agreement, we will provide to you the venue Pueblo Colorado, between the agreed stated start and finish dates.

If the hirer rents Pueblo Colorado under the fully catered option, we agree to provide transportation, accommodation, food, and staff to fulfill our obligations under our rental agreement.

If the hirer rents Pueblo Colorado under the self-catered option, we agree to provide Pueblo Colorado with its facilities and accommodation. We reserve the right to enter the property at any time to undertake essential maintenance or for inspection purposes.

We are not responsible for travel or other costs outside our rental agreement, such as flight cancellations or travel disruptions.

We will not provide refunds, reimbursements, or payments-in-kind in the event that you cannot fulfill your responsibilities.

Please note that Pueblo Colorado is in the jungle of Peru and the hirer and the group should take all appropriate precautions to avoid accidents for which we are not responsible unless they are caused by our facilities or equipment adequately used.

Your responsibilities

You are responsible for:

- Payment of rental fees and any other additional fees within the time prescribed by our rental agreement.

- The behavior of the guests at all times.

- Ensuring all guests are aware of health and safety guidelines which we will explain upon arrival.

- Ensuring the guests' safety and ensuring the hirer's guests conduct themselves and not expose themselves to risk of harm.

- Ensuring the venue facilities and equipment are properly used and not left in a damaged condition.

- Ensuring you and your guest vacate within the designated rental period and that any decorations and hire equipment or other materials brought to Pueblo Colorado are removed prior to checkout.

- Ensuring that you or the guests do not enter the private land of TierraMitica without previous agreement between you and us.

- You have until three days before your arrival to provide us with a complete list of each participant's name and passport numbers, including you.

Health and safety

For your health and safety, we will explain all relevant guidelines concerning our facilities and the surrounding jungle environment.

As the person organizing this event, you are responsible for ensuring your guests, or other onsite representatives, are aware of these safety requirements.

We may terminate our agreement before the agreed end time in the case of an emergency, or if there is a case of a serious and material health and safety risk resulting from your behavior or activities.

You may provide certain equipment and materials

Pueblo Colorado runs on solar power, which provides ample electricity 24 hours a day to power lights, audiovisual equipment, and power outlets throughout our main buildings and executive bungalow. The system is designed to power electrical items such as the television, audiovisual equipment, phone, chargers, computers and intermittent use of the kitchen appliances supplied. It is not equipped to power high-powered appliances such as hair dryers or curling irons. If your electricity needs are greater than what the solar-powered system can provide, an additional generator can be connected to the system. You will be responsible for any damage or cost resulting from our system being overloaded due to equipment or appliances not approved by us.

If you require any additional equipment appliances or material not provided by Pueblo Colorado you must first obtain our approval.

You will not bring, or allow to be brought, dangerous or hazardous substances. Nor may you add to, alter, or attach equipment, fixtures, or fittings to Pueblo Colorado (including stands and other structures) without prior consent.

Booking confirmation, fees and payment

TierraMitica S.A.C. reserves the right to accept or decline a booking at any time.

To confirm the retreat and block out your dates on our calendars, we require an initial deposit of 50% of the total fee at the time of booking.

The remaining balance of 50% of the total fee, plus any additional services requested is due two weeks (14 Days) prior to check-in.

A refundable damage deposit of 430 USD is due two weeks (14 Days) prior to check-in.

Fees and prices will be confirmed in our rental agreement.

Any subsequent requests for goods or services will be added to your final invoice and will have to be paid before check-in, additional services requested throughout your stay will be paid before check-out.

We reserve the right to make a charge to cover additional cleaning costs if the client leaves the property in an unacceptable condition.

We do not offer any compensation for any temporary outage of electricity, gas, water, or internet connection.

Any damage to the venue property other than reasonable wear and tear incurred during the hire period is to the hirer's cost.

Any lost, broken, or missing equipment will be charged at a local replacement cost and is to the hirer's cost.

No booking is confirmed until we notify you in writing.

Cancellation

In the unlikely event that incidents outside our control occur, such as acts of god, government regulation, political or civil unrest, pandemic restrictions, we may terminate our agreement and 100% of your deposits, minus bank transfer fees, will be returned to you.

If you cancel within 48 hours of booking, a full refund will be given, minus bank transfer fees (providing the check-in date is at least 14 days away). A refund of 50% of your deposit, minus bank transfer fees, will be given if you cancel 14 days before the check-in date. If you cancel within 14 days of check-in, the deposit will not be refunded.

Overstay

If you or the group stay past the agreed-upon checkout time without our approval, we are entitled to request you to vacate in a manner consistent with applicable law.

The relationship between the client and TierraMitica S.A.C. is governed by Peruvian law. In the unlikely event that a controversy arises, that cannot be resolved between us, both parties agree to the Peruvian legal system's exclusive jurisdiction.
